Terms of Use

Please read this Terms of Use Agreement ("Agreement") carefully before downloading, installing, using all or any part of the "Perpetual" application ("Application") (including but not limited to the software, files and related documents) or using the services provided by Perpetual to connect to the Application.

You accept and agree to be bound by the terms and conditions of this Agreement when performing the above actions. If you do not agree with any of our terms of use (this version and any updated versions), please do not download, install, use the Application, or uninstall the Application from your mobile device.

This Agreement may be updated regularly by Perpetual; updated versions will be published by us at https://lichvannien.sprogroup.com/terms.

The updated version will replace the terms and conditions of the original agreement. You may access the Application or the above website to view the detailed content of the updated version.

Perpetual is a cultural and entertainment guide application that helps you quickly look up Lunar – Solar dates, create, sync, and search for events across all your logged-in devices, as well as explore a wealth of useful information and knowledge about Culture, history, events, and topics.

This Application was developed and is owned by Perpetual. All intellectual property rights related to the Application (including but not limited to source code, images, data, information, and content contained in the Application; modifications, additions, and updates to the Application) and related documentation (if any) shall belong solely to Perpetual, and no individual or organisation may copy, reproduce, distribute, or otherwise infringe upon the owner's rights without the written consent and permission of Perpetual.

To use the Application you do not need to create an online account. However, to register for advanced services or to access certain other features requiring identification, you must create an account as required by us. You commit that the use of the account must comply with Perpetual's regulations, and that all information you provide to us is accurate, correct, and complete at the time requested.

All your rights and obligations will be based on the account information you have registered; therefore, if any information is incorrect, we will not be responsible in the event that such information affects or limits your rights.

You have the right to use the Application and other services we provide; however, such use shall not include the following acts without the written consent of Perpetual:

• Copying, modifying, reproducing, creating new products or derivative versions based on this Application;
• Selling, transferring, sublicensing, disclosing, or otherwise transferring or providing part or all of the Application to any third party;
• Using the Application to provide services to any third party (organisation or individual);
• Moving, removing, or changing any legitimate notices or marks of the Application (including but not limited to copyright statements);
• Redesigning, compiling, disassembling, modifying, or reversing the design of the Application or its content;
• Changing or cancelling the original state of the Application;
• Using the Application to perform any action that harms Perpetual's network security, including but not limited to using data or accessing unauthorised system servers or accounts; accessing the network to delete, modify, or add information; spreading malicious programs, viruses, or performing any other actions aimed at harming or destroying the network system;
• Logging in and using the Application through a compatible third-party software or system not developed, licensed, or approved by Perpetual;
• Using, selling, lending, copying, modifying, linking to, translating, publishing, announcing information related to the Application, building mirror websites to publish this information, or to develop derivative products, works, or services;
• Using the Application to post, transfer, transmit, or store information that violates the law or national cultural norms;
• Using the Application to use, post, transfer, transmit, or store any content that infringes upon intellectual property rights, trade secrets, or the legal rights of third parties;
• Using the Application or other services provided by Perpetual in any form that violates the law, for any illegal purpose;
• Other forms of violation.

If you violate any provision of this Agreement, Perpetual has the right to immediately lock your account and/or remove all violating information and content. Depending on the nature and severity of the violation, you will also be held responsible before competent authorities, Perpetual, and third parties for all damages caused by or arising from your violation.

(a) When using the Application, you acknowledge that we have the right to use the following system APIs to access data on your phone: (1) Read and write to phone contacts, (2) Obtain your current location with consent, (3) Write Application data to memory card, (4) Access the Internet from your device. All such access is carried out by us with your consent, therefore you commit and acknowledge that, once you have granted us permission, you will have no claims against Perpetual regarding this access.

(b) Along with access, we will collect the following information from you:

• Personal information: includes information you provide to us to verify your account such as name, phone number, ID number, and email address;
• General information: such as information about your phone configuration, and the version of Perpetual you are using on your phone;
• Your location information: your geographic location data will be stored on the server to help you use the Application's search function;
• Phone contacts: we will store your phone contacts on the server to best support you in using the Application and to avoid data loss. We commit to respecting and not using your phone contacts for any purpose without your consent;

We do not use any means to monitor message content, exchanges, or otherwise track users while using this application.

(c) Your content includes your communications with others, posts or feedback submitted to Perpetual, your username, images, documents, audio files, digital products, videos, and your files. To the extent necessary to provide software and services to you and others, to protect you and the services, and to improve Perpetual's products and services, you permit Perpetual to use your content completely free of charge on Perpetual's software and services worldwide; including the rights to copy, store, move, reformat, display, edit, create derivative works, and distribute through communication tools.

Perpetual uses secure HTTPS transmission methods and encryption to transmit and store your personal data and communications. We commit to keeping confidential all information you provide to Perpetual or that we collect from you, and will not disclose it to any third party unless required by a competent State authority.

When using the application, you acknowledge that we have the right to use your non-identifying information to provide targeted advertising content.
